Withdrawal Policy
Last updated: 11 August 2026 (draft – pending legal sign-off)
Scope
The right of withdrawal set out below applies exclusively to consumers within the meaning of § 1 KSchG. Businesses have no statutory right of withdrawal.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us – Claus Nisslmüller e.U. (trading as “Mitterberger:Lab”), Mitterbergerweg 6/EG/G02, 4040 Linz, Austria, VAT ID ATU83081317, company register no. FN 675809m (Regional Court Linz), email office@mitterbergerlab.at – of your decision to withdraw from this contract by means of a clear statement (e.g. by email or post). You may use the model withdrawal form below, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Early lapse of the right of withdrawal for digital content
For contracts for the supply of digital content not supplied on a tangible medium, the right of withdrawal lapses early if (1) you have expressly consented to us beginning performance before the end of the withdrawal period, (2) you have acknowledged that you thereby lose your right of withdrawal once performance begins, and (3) we have provided you with a confirmation of the contract (§ 18 para 1 no 11 FAGG).
We obtain this express consent and acknowledgment during the order process by means of an active checkbox; you receive the contract confirmation by email.
Consequences of withdrawal
If you effectively withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal. For the reimbursement we use the same means of payment that you used for the original transaction; you will not be charged any fees for this.
There is no claim to reimbursement to the extent that the right of withdrawal has already lapsed under the preceding section.
Online withdrawal function from 1 October 2026
For contracts concluded in the online shop on or after 1 October 2026, we additionally provide an easily accessible online withdrawal function (“withdraw from contract”) pursuant to § 13a FAGG, through which you can declare your withdrawal electronically and receive confirmation of receipt.
